1. What is Section 2 About?

Section 2 of the Party Wall etc. Act 1996 gives building owners (the person intending to carry out work) certain rights to alter, repair, or make use of a party wall, while also protecting the adjoining owner (the neighbor). 2. Types of Work Allowed Under Section 2

The Act categorizes different types of work that a building owner may undertake on a party wall, party fence wall, or structure. Below are the key provisions:

(a) Repairs and Maintenance

  • The building owner can repair, maintain, or rebuild a party wall if it is in disrepair or structurally unsound.
  • The work must not cause unnecessary inconvenience to the adjoining owner.

(b) Alteration and Rebuilding

  • The building owner can alter the party wall, such as by inserting beams or removing projections.
  • Rebuilding or increasing the height of the wall is permitted, provided proper notice is given.

(c) Adding Additional Support

  • If a building owner wants to increase the strength of the wall (e.g., adding reinforcement to support additional floors), they have the right to do so.
  • The work must be structurally sound and comply with legal standards.

(d) Cutting into the Party Wall

  • The Act allows cutting into the party wall for structural reasons (e.g., inserting beams or damp-proofing).
  • Proper notice must be served to the adjoining owner before work begins.

(e) Demolition and Reconstruction

  • If the party wall is no longer fit for purpose, the building owner can demolish and rebuild it.
  • The new wall must be built in the same location unless agreed otherwise.

(f) Exposing Party Walls

  • If the party wall is covered (e.g., by plaster or paneling), the building owner may remove coverings to carry out work.
  • They must restore the wall after the work is completed.

(g) Enclosing Walls

  • The building owner has the right to enclose a party wall if it is needed for a structure on their land.
  • They may need to compensate the adjoining owner for any loss of use or value.

3. Notice Requirements (Section 2(2))

Before carrying out any of the above works, the building owner must serve a Party Wall Notice to the adjoining owner. The notice should include:

  • The scope of work and how it will affect the party wall.
  • The timeline for the work.
  • Any potential risks or inconvenience.

The adjoining owner can:

  1. Consent to the work.
  2. Disagree, in which case a Party Wall Surveyor may be needed to resolve disputes.

4. Access Rights Under Section 2(3)

  • The building owner may enter the adjoining property to carry out necessary work.
  • However, they must provide reasonable notice (usually 14 days).
  • They must compensate the adjoining owner for any damage caused.

5. Compensation for Damage (Section 2(5))

  • If the work damages the adjoining owner’s property, the building owner must compensate them for repairs.
  • If a dispute arises, a party wall surveyor will assess the damage and determine compensation.

6. Resolving Disputes

  • If the adjoining owner objects to the work, both parties must appoint surveyors to reach an agreement.
  • If they cannot agree, a third surveyor will be appointed to make a final decision.
  • The surveyor’s decision is legally binding.
