Whether you need a Party Wall Award depends on the type of work you're doing and whether it affects a shared (party) wall, boundary, or structure. Here’s a quick guide:
You need a Party Wall Award if:
- You’re carrying out work on a shared wall (e.g., cutting into a party wall, removing a chimney breast, inserting beams).
- You’re building on or near a boundary (e.g., constructing a new wall on or adjacent to the boundary line).
- You’re excavating near a neighbour’s building (e.g., digging foundations within 3m of their property and deeper than their foundation level).
You don’t need a Party Wall Award if:
- You’re doing minor work (e.g., plastering, electrical work, drilling small holes).
- The work is entirely within your own property and doesn’t affect the party wall.
How to get a Party Wall Award
- Serve a Party Wall Notice to affected neighbours at least 2 months before work starts.
- If they agree, you can proceed without an award.
- If they dissent or don’t respond within 14 days, you must appoint a Party Wall Surveyor (or both parties can appoint one jointly).
- The surveyor will draft a Party Wall Award, outlining the rights and responsibilities.
